These Terms of Service ("Terms") govern your access to and use of PermitFlag, a Chrome browser extension provided by PermitFlag ("we", "us", or "our"). By installing or using PermitFlag, you agree to these Terms.
1. Description of Service
PermitFlag is a Chrome browser extension that reads permit status information from Accela-powered municipal permit portals that you visit, stores that information locally in your browser, and alerts you to changes. PermitFlag is a tool to assist construction professionals — it does not guarantee accuracy of permit data (which is sourced directly from municipal portals) and does not provide legal or regulatory advice.
2. Eligibility
You must be at least 18 years old and have the legal capacity to enter into this agreement. By using PermitFlag, you represent that you meet these requirements.
3. Subscription and Payment
- Free trial: PermitFlag offers a 14-day free trial. No credit card is required to begin the trial.
- Subscription fee: After the trial period, continued use requires a paid subscription at $19 per user per month (billed monthly) or $149 per user per year (billed annually).
- Payment processing: Payments are processed by ExtensionPay (using Stripe). You agree to ExtensionPay's terms of service when subscribing.
- Cancellation: You may cancel your subscription at any time. Your access continues until the end of the current billing period. No refunds are provided for partial months.
- Price changes: We reserve the right to change subscription pricing with 30 days' notice via email or in-extension notification.
4. Acceptable Use
You agree to use PermitFlag only for lawful purposes and in accordance with these Terms. You agree not to:
- Use PermitFlag to access permit portals you are not authorized to access.
- Attempt to reverse engineer, decompile, or extract source code from the extension beyond what applicable law permits.
- Use PermitFlag to scrape, archive, or redistribute municipal permit data at scale for commercial resale.
- Circumvent any access controls or rate limits imposed by municipal permit portals.
5. Disclaimer of Warranties
PermitFlag is provided "as is" without warranty of any kind. We do not warrant that the extension will be error-free, that permit data read from municipal portals will be accurate or current, or that the service will be available at all times. Municipal permit portals may change their structure without notice, which may temporarily affect PermitFlag's ability to read data.
Permit data accuracy: PermitFlag reads data directly from the municipal portal pages you visit. We make no representations about the accuracy, completeness, or timeliness of permit status information. Always verify critical permit decisions with the issuing authority.
6. Limitation of Liability
To the maximum extent permitted by law, PermitFlag's total liability for any claim arising from your use of the service shall not exceed the amount you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits or permit-related financial losses.
7. Intellectual Property
PermitFlag and its source code are proprietary. These Terms do not grant you any ownership rights in the extension. The PermitFlag name and logo are trademarks of PermitFlag.
8. Termination
We reserve the right to suspend or terminate your access to PermitFlag if you violate these Terms. Upon termination, your locally stored data remains in your browser — we do not delete it because we never had access to it.
9. Governing Law
These Terms are governed by the laws of the United States and the state in which PermitFlag is registered, without regard to conflict of law principles.
10. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via in-extension notification or email (if you have provided one during subscription). Continued use after notice constitutes acceptance.
